A license suspension or long-term denial of driving privileges can have devastating effects on a person’s life. The court fines and possible jail time from driving illegally, the stress of getting pulled over if you do drive and the stress of losing your job if you don’t drive can certainly take a toll. Fortunately, if your license is suspended, revoked or denied in Missouri you may be eligible for a Limited Driving Privilege (LDP). A limited driving privilege allows people currently serving a suspension, revocation or denial to drive in conjunction with work, school, medical and other court-approved destinations. Who is eligible
If you are currently serving a 5 year denial or a 10 year denial you may be eligible for an LDP.
5 YEAR DENIAL
Two convictions for DUI or DWI within a five year period results in a five year denial.
10 YEAR DENIAL
Three or more convictions for DUI or DWI in a lifetime results in a ten year denial.
In order for the court to grant the petition, the suspended driver must show satisfactory evidence that their habits and conduct have changed so that they no longer pose a danger to public safety. There will be a hearing in front of a judge to determine if this qualification has been met. The petitioner will also need to obtain SR-22 insurance as well as ignition interlock. If the court grants the petition for Limited Driving Privilege, then proof of all 3 must be filed with the Department of Revenue.
Reinstatement
After the term of a denial or suspension has been served you must file a petition for reinstatement with the Circuit Court in which you received your last alcohol or drug related driving conviction that led to your license denial. The petitioner will need to show satisfactory evidence that their habits and conduct have changed so that they no longer pose a danger to public safety. The petitioner will need to register for fingerprinting with MACHS (Missouri Automated Criminal History Site) after they obtain the four digit code from the Circuit Court in which they filed the petition. The petitioner will be required to obtain and maintain ignition interlock for 6 months after the court grants the petition for reinstatement.
