Factors that could make you ineligible for a Missouri Hardship License

Under Missouri law, these are some reasons restricting someone from receiving a Limited Driving Privilege (LDP):

  1. Even though your Missouri privilege is eligible for reinstatement, not all of the requirements for reinstatement have been met at this time.
  2. Over the past five years, you have been convicted of a felony involving a motor vehicle.
  3. Commercial driving privileges are suspended, revoked, canceled, or disqualified (NOTE: A non-commercial LDP is the only LDP that can be issued in this case)
  4. Your license was revoked for failing to pass a driving or medical examination as required by the Director of Revenue.
  5. Your license was suspended for having an unsatisfied motor vehicle judgment (until you have made all payments and all compliance has also been met).
  6. A suspension for failure to pay a ticket in Missouri or another state (Until all payments have been made and compliance has been met).
  7. A conviction of driving while intoxicated (Missouri DWI) or drunk driving with an excessive blood alcohol concentration (BAC) has resulted in a driver’s license suspension. There is a chance you may be eligible for a Restricted Driving Privilege (RDP) or Restricted License in this case.
  8. You may also be eligible for a Restricted Driving Privilege (RDP) if you have an Administrative Alcohol Suspension (because you were driving a motor vehicle with a blood-alcohol level that was over the legal limit).
  9. You are not currently a resident of the state of Missouri. Or if you are a resident of another state, you do not work or attend a school in the state of Missouri.

After submitting an application, file a petition with the circuit court in the county where you live or work to receive an LDP:

  • If you file a petition with the court, there will be a filing fee and court costs to go along with it.
  • Legal advice must be sought out when filing your petition.
  • If an LDP is granted by the court, it is required you have an SR-22 form on with the Department, or else your insurance company will need to provide this information. You also have the option to submit a copy of the SR-22 form to the Department if you would like.
  • If you have more than one Missouri DWI or an active Chemical Revocation offense on your driver record, it is required you submit proof of installation of an Ignition Interlock Device (IID). After installation of the device, the installer must notify the Department of Revenue that it is installed and completed on any vehicle that you operate. The Department of Transportation has to certify this device as well. Depending on the reason for the IID, it may need to be installed with a camera. This is the case if you are seeking an LDP because you have a 5 or 10-year Denial on your record. Having a GPS installed with it is also sometimes required by the court in some instances. The court has the ability to require an IID if you only have one alcohol offense, and the device must be maintained throughout the entire duration of the LDP.   • If the court does grant you the LDP, an Order Granting Limited Driving Privilege will be given to you and will serve as your documentation for driving. The Department of Revenue must have a copy of this order on file in order for you to drive.
